1. No Insurance Contract or Coverage Guarantee

Information presented through our website, agents, quoting tools, or marketing is for educational and informational purposes only.
Completion of forms, submission of inquiries, speaking with an agent, or receiving a quote does not create coverage, a binder, or agent-of-record status.

Coverage is only effective when:

• The carrier approves the application,
• All underwriting requirements are met, and
• Confirmation of enrollment or policy issuance is acknowledged by the carrier.

InsuranceTS is not responsible for carrier underwriting decisions, rate changes, plan availability, enrollment timing, or denial of applications.

2. Quote Accuracy Disclaimer

Quotes or plan summaries provided through our platforms, agents, CRMs, SunFire, carriers, or third-party tools are estimates, not guarantees of premium, benefits, effective dates, or eligibility.

Final plan determinations are made solely by the carrier, Medicare/CMS, or relevant regulatory authority.

3. No Warranty / No Professional Advice Guarantee

We make reasonable efforts to provide accurate content but do not warrant:

• completeness
• timeliness
• accuracy
• benefit availability
• policy eligibility

All information is provided “as-is” without warranties of any kind.

Nothing on this site constitutes legal, tax, financial, or medical advice. Users must consult qualified professionals before making decisions.

4. Limitation of Liability

To the fullest extent permitted by law, InsuranceTS, its agents, affiliates, contractors, or partners shall not be liable for:

• reliance on website materials, quotes, or agent communications
• delays or failures in enrollment processing
• errors from carriers, Medicare portals, SunFire, quoting platforms, or third parties
• lost data, revenue, or expected benefit outcomes

In no event shall our liability exceed the amount you paid for services received through our website, or $100, whichever is lower.

5. Carrier & Third-Party Responsibility Disclaimer

InsuranceTS may assist with applications, quoting, Medicare enrollment options, and plan comparisons.
We do not control or guarantee carrier actions, coverage decisions, reimbursements, benefits, billing, premium changes, formulary status, or claims handling.

All carrier obligations and benefit determinations are the sole responsibility of the insurance carrier, Medicare/CMS, or applicable regulatory body.

6. Communications Consent / TCPA Notice

By providing your contact information, you consent for InsuranceTS and/or its licensed agents to contact you via:

• email,
• phone calls, and
• SMS text messages

for insurance-related purposes.
You may opt-out at any time by emailing Fitzpatrick@insurancets.com or replying STOP to SMS.

7. Arbitration Agreement

Except where prohibited by law, all disputes, claims, or controversies arising out of or relating to your use of the Service shall be resolved by binding arbitration administered by a neutral arbitrator.

You waive your right to a trial by jury.

8. Class Action Waiver

To the fullest extent permitted, you agree that claims must be brought individually — not as part of a class, consolidated, representative action, or group proceeding.

The arbitrator has no authority to consolidate claims or preside over class-wide proceedings.

9. User Responsibilities

You agree not to:

• misuse our site
• input false information
• impersonate others
• submit applications without consent
• misuse carrier enrollment tools or quoting systems

InsuranceTS may suspend services for abusive, fraudulent, or unlawful behavior.

10. Jurisdiction & Governing Law

These Terms are governed by the laws of the following states, depending on where you reside or where services are rendered:

Alabama (AL), Arkansas (AR), Arizona (AZ), Colorado (CO), Iowa (IA), Idaho (ID), Minnesota (MN), Montana (MT), Nebraska (NE), North Dakota (ND), Oklahoma (OK), South Dakota (SD), Texas (TX), Utah (UT), Wisconsin (WI), Wyoming (WY)

Venue for enforcement or arbitration shall be the state where:

• the consumer resides, or
• services were provided,

unless mutually agreed otherwise.

11. Termination of Service

InsuranceTS may suspend or terminate access to the Service at any time for:

• misuse
• legal compliance
• system abuse
• fraudulent or hostile behavior

These Terms remain enforceable after termination.

12. Changes to Terms

We may update these Terms periodically.
Revised versions will be posted with an updated “Last Updated” date. Continued use constitutes acceptance.
